CSE Terms and Conditions

1 General information

  • Definitions

Capitalized terms and expressions used in these General Terms and Conditions of Sale shall have the following meaning, whether used in the singular or the plural:

"Customer": Refers to any individual or legal entity purchasing Services from the Vendor.

"Vendor": Refers to GIP Terra Botanica

"Parties": Includes Customer and Seller

"Order" means all the Services purchased by the Customer

"Season" refers to the opening period of the Terra Botanica park in year N. If the purchase of Services is made during a closed period, then the season corresponds to the nearest future opening period, from April to November.

"Website": The Website comprises all the pages referenced on the main domain name www.terrabotanica.fr.

"Access Pass": Includes all entry tickets for access to the park and Terra Nocta.

"Services": Refers to all products sold to the customer. It includes access passes (entrance tickets and season passes), catering products, vouchers and exchange vouchers.

"Professional Platform": Web interface, available from the Terra Botanica website. Only for elected members of a CSE (Comité Social Entreprise).

"Partnership Agreement: Contractualization of the provision of the Professional Platform

 

1.1 These General Terms and Conditions apply to any Internet Order for one or more Access Tickets purchased by the Customer from the Professional Ticketing Platform on the Vendor's Internet Site. The full terms and conditions are available for consultation on the Vendor's Internet Site,

1.2 The Customer declares that he/she has the legal capacity to enter into this contract, i.e. has reached the age of majority and is not under guardianship or trusteeship.

1.3 The signing of the Partnership Agreement and the placing of the Order imply the Customer's express and unreserved acceptance of all the clauses and conditions set out in these GTS.

1.4 The Vendor reserves the right to unilaterally modify these GCS at any time and to apply them to all Orders placed after the date of modification.

1.5 Access Passes allow access to the park and its attractions for the entire Season (excluding tethered balloon flights). All Services are valid for the Season.

2.3 Online ordering procedure on the Website via the Professional Platform

To place an order, customers must first identify themselves by creating a secure account (login and password) and completing the Partnership Agreement. The Partnership Agreement will become effective within 2 working days of receipt by the customer's ticketing department.

After logging in, the Customer fills in the form with details of the Services required. Before definitively registering an order, the Customer will be able to check his selection (basket) and modify it at his convenience.

Validation of the Order will take place via the "Proceed to payment" button and will result in immediate or deferred payment of the Order, depending on the option chosen. All validated orders are payable.

Services purchased on the Professional Platform are delivered digitally and can be printed directly by the customer using their own equipment or presented on a digital medium (smartphone, etc.).

All information appearing on confirmation e-mails will be deemed to have been accepted by the Customer if they have not contested them by registered letter with acknowledgement of receipt within 14 days. However, they may not be contested if they differ from their Order.

By keeping and/or printing the confirmation page or the e-mail sent by the Vendor, the Customer has proof of his/her order.

The Partnership Agreement for the sale of CSE services is renewed by tacit agreement at the end of the season. At the end of the season, prices will be updated and an email sent to the Customer. If the Customer wishes to terminate the Partnership Agreement, a letter will be sent with acknowledgement of receipt to the attention of the CSE department. The account may be reactivated at any time at the Customer's request.

The Professional Platform is reserved exclusively for elected members of the CSE. The Seller may not be held liable for any other use that may be detrimental to the CSE. In the event of defects in use, the Seller may claim damages.

 

 

 

  • Price

All prices are in euros and include VAT.

Prices may vary according to applicable VAT rates.

Once the Order has been confirmed and paid for, the Seller cannot retroactively apply discounts and one-off promotional offers.

  • Terms of payment

The Customer may pay by cheque, bank transfer in the case of Orders placed via a paper order form or by telephone.

For customers who have opted for the Partnership Agreement, payment may be made by credit card in the case of immediate payment, or within 30 days of receipt of invoice in the case of deferred payment.

 

 

  • Services

 

 

5.1 Access rights

Access Tickets purchased on the Online Platform will be valid for 1 day on a specific date (dated ticket) or over a period (undated ticket).

For Terra Nocta only, Access Passes are time-stamped (day and time specified on the ticket) or issued in the form of undated countermarks, which must be exchanged at the park ticket office. The counterfoil is not a ticket, but a procedure is indicated on the ticket.

5.2 Ticket validity, access and control

The conditions of validity and access of the Access Ticket are mentioned on the ticket. They are neither exchangeable nor refundable, and are valid for the current Season.

Access Passes grant access to the Park or Terra Nocta to a single customer, once only (except for special offers). Depending on the type of Access Pass, it may be checked several times.

For Terra Nocta, management reserves the right to refuse admission if the show is not held to schedule. Only the first person to present an Internet ticket will be admitted, who is presumed to be the legitimate ticket holder.

All Access Tickets and Services may be checked at the cash desk at the entrance to the Terra Botanica park, at access control or at any other point of sale. In the absence of proof of these specific rates, the Seller is entitled to charge the difference with the ticket.

All Access Passes will not give rise to any special benefits in the event of overcrowding.

The Vendor cannot be held responsible for any fraudulent use, loss or theft of Access Cards.

 

5.4 PASS SAISON specific conditions

Season Passes allow unlimited access to the park throughout the current Season, and entitle holders to benefits over the period. All benefits for Pass holders can be viewed on the dedicated website page.

Passes are non-refundable and cannot be transferred or exchanged. They do not entitle the holder to priority bookings or times, whatever the services concerned.

There are no special rates for the Ballon Captif (on-site ticketing subject to weather conditions).

 

If you lose or forget your season pass, you will be charged for a new one.

Depending on the type of Pass chosen, access conditions and benefits may vary.

For Premium Passes only, reservations for Terra Nocta (dates and times) must be made at the park ticket office, before the show (subject to availability).

 

5.5 Specific mention of ticketing

It is strictly forbidden to reproduce, duplicate or counterfeit an Access Ticket, to make them available for such purposes or to use copies of these documents.

It may happen that certain activities indicated in the description on the Site are cancelled, notably for climatic reasons or in the event of force majeure. Cancellation of any activity by the Vendor without prior notice shall not in any event entail any compensation to the Customer.

The descriptions of the electronic tickets presented on the Internet Ticketing Service specify, for each product, the services included in the price. Prices are given in Euros and include all taxes, unless otherwise stated on the Internet Ticket Office.

In general, and unless expressly stated otherwise, prices do not include insurance and all personal expenses (food, drink, tips) and more generally any service not expressly mentioned on the Internet Ticketing Service.

The Vendor alone is responsible for the proper distribution of Access Rights, and is fully responsible for resale in accordance with the Partnership Agreement. It is responsible for any claims and reimbursement procedures.

 

 

  • Changes or cancellation

Any request for cancellation or modification of the electronic ticket by the Customer must be sent and justified by registered letter with acknowledgement of receipt to the attention of the Vendor at the following address: TERRA BOTANICA ' Service BILLETTERIE EN LIGNE ' route d'Epinard CS 80609 49106 ANGERS cedex 2.

Except in the case of force majeure (defined in paragraph 8), in the event of cancellation of one or more Services by the Customer, all sums paid by the Customer to the Vendor shall be retained by the Vendor without prejudice to any damages that the Vendor may claim as a result of the loss suffered by the Customer as a result of the cancellation.

The Vendor will not be able to reimburse any of the Services defined in these GTS in the event of: non-use by the Customer, for reasons related to the climate or the exceptional cancellation of a show or product for any reason whatsoever.

 

7 Responsibilities

 

7.1 The Vendor may be exonerated from all or part of its liability by proving that the non-performance or improper performance of the contract is attributable either to the Customer, or to the unforeseeable and insurmountable act of a third party or an event unrelated to the provision of the services provided for in the GTCS, or to a case of force majeure.

 

7.2 The Customer shall be held liable for any damage, direct or indirect, that subscribers may cause during their presence in the Parc Terra Botanica, whether to Terra Botanica staff and/or customers or to any equipment made available to the Customer by the Vendor.

 

7.3 The Vendor declines all responsibility for damage of any kind. Each visitor is responsible for any damage, direct or indirect, that he or she may cause while visiting the Park.

 

7.4 Parc Terra Botanica cannot be held responsible in the event of loss or theft of the ticket.

 

8 Forces Majeures

With the exception of the elements of French Jurisprudence concerning the qualification of force majeure, the obligations of the Vendor are de facto suspended without being held responsible for non-performance of all or part of the product in the event of an event beyond its control: cyber-attack, flood, fire, epidemic, logistical breakdown, strike at the Vendor's premises, blockage, transport strike, riots, vandalism, fire, flood, major supplier forces.

The Parties reserve the right, without payment of any penalty or indemnity whatsoever, to cancel the performance of the Services in the event of force majeure or unforeseen circumstances. In the same way, the management of Parc Terra Botanica reserves the right to modify, without payment of any penalty or indemnity whatsoever, all the Services if forced to do so by events of force majeure or unforeseen circumstances.

 

8 Disputes

These GCS are governed by French law. Any dispute shall be subject to the jurisdiction of the French courts.

 

9 Personal data

The information collected on the Internet ticketing service is intended exclusively for Terra Botanica and enables commercial management between the Customer and the Vendor. In particular:

- responding to requests for information made on the Site

- placing and managing orders

- the sending of commercial information when the Customer has given his consent or when authorized by current legislation

- to compile general statistics on Site visits in order to improve the services offered by the Vendor on its Internet Site

In accordance with the French Data Protection Act no. 78-17 of January 6, 1978. Customers have the right to access, modify, delete or port their data at any time.
