TERRA BOTANICA TERMS AND CONDITIONS OF SALE
ONLINE TICKETING

In these general terms and conditions of sale (hereinafter referred to as "GTC"), the following definitions apply

"Site": Internet site located at the following URL address: https://www.terrabotanica.fr
"Park": TERRA BOTANICA located in Angers.
"CUSTOMER": any natural or legal person with whom TERRA BOTANICA concludes a sales contract.
"Order": any contract binding the CLIENT to TERRA BOTANICA for the execution of the sale of tourist products.
"Online ticketing": specific portal of the TERRA BOTANICA.fr website allowing the purchase of one or more tourist products.

1/ GENERAL
Article 1.1: These GTC apply to any Internet order for one or more electronic tickets purchased by the CLIENT from the TERRA BOTANICA Internet Ticket Office. These GTC can be consulted on the website.

Article 1.2: The CLIENT declares that he/she has the capacity to enter into this contract, i.e. that he/she has reached the age of majority and that he/she is not under guardianship or curatorship.

Article 1.3: Placing an Order implies the express and unreserved acceptance by the CLIENT of all the clauses and conditions set out in these GTC.

Article 1.4: TERRA BOTANICA reserves the right to unilaterally modify these GTC at any time and to apply them to all Orders placed after the date of modification.

Article 1.5: The entrance ticket allows access to the park and its attractions* during the days and hours the park is open. (*excluding balloons)

2/ ORDERS
Article 2.1: Orders for electronic tickets are subject to these GTCs and the park's internal regulations.

Article 2.2: To place an order, each CUSTOMER must identify himself by creating a secure account with identifiers (login and password).
After logging in, the CUSTOMER will fill in the form with the details of the services required. Before definitively registering an order, the CUSTOMER will be able to check his selection (basket) and modify it at his convenience. All tickets issued will be due the following month on a summary invoice to be settled within 30 days.

Article 2.3: The validation of the order will be done via the "Proceed to payment" button. However, payment for this Order will only be required the following month when a summary invoice is issued.

Article 2.4: All information contained in the confirmation emails will be deemed to have been accepted by the CLIENT if it has not contested them by registered letter with acknowledgement of receipt within 14 days. However, they may only be contested insofar as they differ from their Order.

Article 2.5: By keeping and/or printing the confirmation page or the e-mail sent by TERRA BOTANICA, the CLIENT has proof of his order.

Article 2.6: The tickets purchased for access to the park can be printed out directly by the customer using their own equipment. The tickets can also be presented on a smartphone at the park's access control.

Article 2.7: Once the order has been confirmed and paid for, TERRA BOTANICA cannot apply discounts and one-off promotional offers retroactively.

Article 2.8: Tickets purchased via the TERRA BOTANICA website will be valid for 1 day for a specific date (dated ticket) or over a period (undated ticket). For Terra Nocta, the tickets are accessible on the partner's ticketing area, the tickets are time-stamped (day and time specified on the ticket) or issued in the form of undated countermarks that must be exchanged on the park's ticketing area. The counter-mark is not a ticket, a procedure is indicated on the ticket. The conditions of validity and access to the ticket are mentioned on the ticket. They are also neither exchangeable nor refundable. Each printed Internet ticket has a unique barcode that is checked and registered at the entrance to TERRA BOTANICA using barcode readers. It allows access to the Park for a single customer and only once (except for specific offers). Depending on the type of ticket (combined ticket, 2-day ticket, Terra Nocta ticket), the ticket may be checked more than once. However, it is impossible to be admitted several times to the Park for the same service with the same Internet ticket. In the case of Terra Nocta, the management reserves the right not to allow entry if the show is not held on time. Only the first person to present the Internet ticket will be admitted, who is presumed to be the legitimate ticket holder.

Article 2.9: Internet tickets for adults/children/families may be checked at the TERRA BOTANICA park entrance and at the access control. In the absence of documents justifying these specific rates, TERRA BOTANICA is entitled to charge the difference with the ticket.

Article 2.10: It is strictly forbidden to reproduce, duplicate or counterfeit an Internet ticket, to make them available for such purposes or to use copies of these documents. Such acts are liable to criminal prosecution, without prejudice to the damages that TERRA BOTANICA may be entitled to claim from the offenders by virtue of the loss suffered.

3/ GENERAL RULES FOR THE SALE OF ELECTRONIC TICKETS
Article 3.1: Any electronic ticket purchased by the CUSTOMER for access to the Park may not give rise to any particular advantage in the event of a large number of visitors.
It may happen that some of the activities indicated in the description on the Website may be cancelled, particularly for climatic reasons, in the event of force majeure or in the event of a stay outside the tourist season. The cancellation of any activity due to force majeure or the behaviour of a third party to the contract shall not in any case result in any compensation to the CLIENT by TERRA BOTANICA.

Article 3.2: The descriptions of the electronic tickets presented on the Internet Ticket Office specify, for each product, the services included in the price. The prices are indicated in Euros and are understood to include all taxes, unless otherwise stated on the Internet Ticket Office.
In general, and unless expressly stated otherwise, the prices do not include insurance and all personal expenses (catering, drinks, tips) and more generally any service not expressly mentioned on the Internet Ticketing Service.
The prices shown on the Internet Ticketing Service may be modified at any time, without prior notice, it being understood that such modifications will be inapplicable to reservations previously accepted. The age groups defining the different ticket prices are explicitly defined on the Site.

Article 3.3: Payment shall be made on receipt of the invoice and within 30 days by bank transfer or cheque.

Article 3.4: TERRA BOTANICA will issue a summary invoice showing the date and amount of the CLIENT's purchases.

CANCELLATION AND MODIFICATION
Article 3.5: Any request for cancellation or modification of the electronic ticket by the CLIENT must be sent by registered letter with acknowledgement of receipt to TERRA BOTANICA, at the following address TERRA BOTANICA ' Service BILLETTERIE EN LIGNE ' route d'Epinard SC 80609 49106 ANGERS Cedex 2.
Except in cases of force majeure, in the event of cancellation of the Tourist Product by the CLIENT, all sums paid by the CLIENT to TERRA BOTANICA will be retained by TERRA BOTANICA without prejudice to any damages that TERRA BOTANICA may claim as a result of the prejudice suffered by the cancellation.

4/ LIABILITY
Article 4.1: TERRA BOTANICA may be exempted from all or part of its liability by proving that the non-performance or poor performance of the contract is attributable either to the CLIENT, or to the unforeseeable and insurmountable act of a third party or an event unrelated to the provision of the services provided for in the GTCs, or to force majeure.

Article 4.2: The CLIENT will be held responsible for any damage, direct or indirect, that the subscribers may cause during their presence in the TERRA BOTANICA Park, whether to TERRA BOTANICA staff and/or clientele, or to any material made available to the CLIENT by TERRA BOTANICA.

Article 4.3: TERRA BOTANICA declines all responsibility for damage of any kind. Indeed, each visitor is responsible for any damage, direct or indirect, that he or she may cause while in the Park.

Article 4.4: TERRA BOTANICA may not be held liable in any way, particularly in the event of loss or theft of the ticket. However, a duplicate may be issued at the dedicated ticket office on presentation of an identity document, identifier and date of reservation, provided that the ticket has not been used.

5/ CANCELLATION
TERRA BOTANICA will not be able to reimburse any of the services defined in these GTC in the event of: (i) non-use by the CLIENT under the conditions referred to in article 3.5 hereof; (ii) for a reason related to the climate or the exceptional cancellation of a show for any reason whatsoever.

6/ FORCE MAJEURE
The Parties reserve the right to cancel the execution of the Tourist Product, without payment of any penalty or compensation, if force majeure or unforeseen circumstances force them to do so. Likewise, the management of TERRA BOTANICA reserves the right to modify, without payment of any penalty or compensation, the programme of the Tourist Product if forced to do so by events of force majeure or unforeseen circumstances.

7/ APPLICABLE LAW, CLAIMS AND DISPUTES
Article 7.1: These GTC are subject to French law.

Article 7.2: Any complaint arising during the execution of the services defined herein must be introduced as soon as possible by the CLIENT, on site and in an appropriate manner, so that TERRA BOTANICA can seek a solution as soon as possible. In any case, the CLIENT must send complaints to TERRA BOTANICA by registered letter within one month of the date of execution of the services. This letter must specify the Order number and the precise reasons for the complaint.

8/ PERSONAL DATA
Article 8.1: The information collected on the Internet Ticketing service is intended for TERRA BOTANICA. It is subject to computer processing for the purpose of processing the CUSTOMER's request and TERRA BOTANICA's commercial management, in particular
- responding to requests for information made on the Site,
- placing and managing orders,
- sending commercial information when the CUSTOMER has given its consent or when authorised by the legislation in force,
- the compilation of general statistics on visits to the Site in order to improve the services that TERRA BOTANICA offers on the Site.

Article 8.2: In accordance with Law n°78-17 of 6 January 1978 relating to information technology, files and freedoms, the CUSTOMER has the right to access, rectify and delete information concerning him or her, which the CUSTOMER may exercise by contacting TERRA BOTANICA.
This is an individual right that can only be exercised by the person concerned in relation to his or her own information: for security reasons, TERRA BOTANICA must verify his or her identity in order to avoid any communication of confidential information concerning him or her to anyone other than him or her. The CUSTOMER's data may be transmitted by TERRA BOTANICA to third parties for commercial prospecting purposes, provided that the CUSTOMER has given his consent on the registration form that he has filled in.

Article 8.3: The fields of the registration forms followed by an asterisk must be filled in. Otherwise, TERRA BOTANICA will not be able to take the registration request into account.

Article 8.4: The CLIENT's name and password that are assigned to him when he registers for the creation of an account are personal and confidential. The password assigned to the CUSTOMER will be renewed automatically every day, unless the CUSTOMER has given a written and signed counter-indication.
